Political experts believe that what Congress will pass a law in 2009 that would effectively eliminate the secret-ballot election and allow Union's to become employees' certified representative on the basis of signed union cards.

An Employer presented with a union petition of signed employee authorization would no longer have the ability to communicate its position and preference concerning unions.

And, once the NLRB certifies the Union, bargaining on the initial contract would have to commence within 10 days after a Union request to bargain; And, if the union and company have not agreed upon a contract, mediation would be required; And, if after 30 days of mediation, they have not agreed on the contract's terms, then the contract terms would be determined by an arbitration board established by the Federal Mediation and Conciliation Service. This federally imposed contract would remain in effect for two years.
